ANNEX 1

 

“TAKE ART AWAY” COMPETITION TERMS

 

ORGANISER – COMPETITION NAME – ELIGIBILITY – PRIZES

1. The company with the corporate name KAFEA TERRA FOOD AND DRINKS S.A. whose registered offices are at 12-14 Naxou St., Peania, Attica (the “Company”) is organising a competition by the name “take art away” to select two (2) artworks which will adorn the disposable cups for illy products by the name “illy take away cup” with the assistance of / under the aegis of the Athens School of Fine Arts (hereinafter ”ASFA”) (the “Competition”).
2. All students of ASFA are eligible to participate in the Competition by submitting one (1) project each, which meets the specifications and complies with the technical instructions of the Competition available here https://illytakeartaway.gr/wp.content/uploads/2024/12/Competition_Instructions.pdf. Students who do not have full legal capacity may also participate in the Competition under the conditions laid down by law.
3. Participants in the Competition must register on the Competition website using their ASFA unique registration number. When registering on the said Competition website, each participant must carefully read the Competition’s Terms and Conditions of Participation and electronically accept them. Participants must submit their Artwork by uploading it to the said website by 23:59 hours on Sunday 30/03/2025. The two (2) Competition winners must sign the Competition’s Terms and Conditions of Participation and send them to the Company within five (5) days at the latest from being informed about the results of the Competition in an email from the Company. The two (2) winners may either sign the Competition’s Terms and Conditions of Participation in person and send them by mail to the Company’s registered offices 12-14 Naxou St., Peania, Attica, GR-19002, or digitally confirm the Competition’s Terms and Conditions of Participation (digital document certificate) on the gov.gr platform and send them by email to the Company at the email address illytakeartaway@gmail.com. If the two (2) winners do not send the Competition’s Terms and Conditions of Participation signed in accordance with the above within that deadline, their place will be taken by the next highest scoring Artwork.
4. The jury which will score the Artworks will receive the Artworks electronically without the identity of the artists being revealed to them. The jury will consist of one (1) professor from ASFA, one (1) executive from the Company and two (2) executives from the Italian company illycaffè S.p.A. The artists who shall create the two (2) highest scoring Artworks will be chosen as winners, will receive a cash prize of € 3,000 each and their works will decorate the “illy take away cup”, namely 4, 8, 12 and 16 oz. disposable cups for illy products.

 

AWARD CEREMONY – HANDOVER OF PRIZES

5. The announcement of the score, an exhibition featuring the twenty (20) best Artworks in the Competition, the announcement of the two (2) winners from among them and the award of the Competition prizes will take place during an event to be held at ASFA. The artists who created the twenty (20) best Artworks in the Competition will be informed by email about the results of the Competition, and about the date and time of the said event. The event will be promoted in the Company’s printed and online press and social media channels, and the winners will be photographed along with their artworks. The winners are obliged to participate in other activities and actions to promote the “take art away” competition and the Artworks which will adorn the illy take away cup disposable cups for illy products.
6. Where the two (2) winners do not attend the said event to collect their prize, the prize may be picked up at the Company’s registered offices by arrangement on another date and time within ten (10) days from dispatch of the said email. If a winner refuses to accept the prize in writing or does not take receipt of the prize within ten (10) days from sending the email or it is found that the appropriate conditions for participating in the Competition were not met, they shall lose their relevant right. In this case, the Company shall be released from all obligations towards the specific winner and shall contact the next participant in the order of ranking.
7. The prize may be picked up by the winner after their particulars have been confirmed by showing their ID card. Where the winner cannot be present to take receipt of the prize, they are obliged to appoint a representative who must submit an authorisation via gov.gr which must be sent to the Company, and that person’s particulars must also be confirmed along with those of the winner when the prize is collected.

 

INTELLECTUAL PROPERTY

8. The economic rights in the two (2) artworks to be awarded in the Competition shall be transferred in their entirety and shall belong to the Italian company illycaffè S.p.A. to enable the Artworks to be used to adorn the “illy take away cup” disposable cups for illy products in accordance with the Competition’s Terms and Conditions of Participation which can be found here: illytakeartaway.gr/οροι-συμμετοχης-στον-διαγωνισμο-illy/.
9. By accepting the Competition’s Terms and Conditions of Participation, each participant in the Competition agrees that they in person, and their Artworks will be featured in photographs and videos taken at the event to showcase the twenty (20) best Artworks in the Competition and the two (2) winners thereof and the prize ceremony. All the above will be used to promote the products in the printed and electronic press and social media.

 

EXCLUSIONS FROM PARTICIPATION

10. Company executives and employees and the spouses and relatives of the said natural persons by blood or marriage up to the second degree are excluded from the Competition.
11. Entries whose content is abusive, racist, contrary to law, offensive to public decency and morality or in any manner indecent shall, at the Company’s unfettered discretion, not be accepted. Entries which do not meet the specifications and technical guidelines for the Competition available here: illytakeartaway.gr/οροι-διαγωνισμου-take-art-away/ will also not be accepted.

 

OTHER TERMS AND CONDITIONS

12. Participants are exclusively responsible for fully and correctly filling out and submitting their particulars in the Competition Terms and Conditions of Participation. The Company relies on the correctness, truth and legality of the information declared by participants in the Competition Terms and Conditions of Participation and is not obliged or in a position to check such. Where a participant provides incomplete or incorrect or untrue particulars which are required by the Competition’s Terms and Conditions of Participation, the Company shall be entitled to cancel their entry in the Competition.
13. Participants are obliged to behave in accordance with good faith and morality during the entire Competition until the winners are selected and thereafter in relation to the Competition.
14. The prizes are specific, personal and cannot be exchanged.
15. The Company’s liability is limited solely and exclusively to the prizes cited above.
16. Participants do not have or do not acquire any rights whatsoever in the trademarks, names, markings, logos and other distinctive marks of the Company and the Italian company illycaffè S.p.A.
17. The Competition’s Terms and Conditions of Participation have been placed on file with the Athens-based notary public, Mr. Alexios Fotopoulos, son of Dimitrios. The Company reserves the right at its unfettered discretion to unilaterally amend the Competition’s Terms and Conditions of Participation. Any such amendment shall be placed on file with the said notary public and published on the Company’s website illytakeartaway.gr/οροι-διαγωνισμου-take-art-away/ as shall these Terms and Conditions of Participation in the Competition.
18. The applicable laws are those of Greece. The courts of Athens (central headquarters) shall be exclusively competent to resolve any dispute relating to the Competition.

 

PERSONAL DATA

1. KAFEA TERRA FOOD AND DRINKS S.A., whose registered offices are at 12-14 Naxou St., Peania, Attica, tel. 2130905500, email info@kafeaterra.gr, is the data controller.
2. The Company collects and retains the personal data of participants set out in the Competition’s Terms and Conditions of Participation which data is necessary to run the Competition, such as name-surname, email address, ASFA register number, and phone number.
3. The Company processes personal data in hard copy, automated or electronic means, including mail or email, fixed and mobile telephony. The Company takes suitable administrative, technical and physical security measures to protect data from accidental, unlawful or unauthorised use, destruction, loss, modification, disclosure, acquisition or access.
4. Company employees associated with the Competition and third party associates used by the Company as processors for the Competition will have access to that data.
5. The Company will keep the personal data of participants until the end of the Competition and after that to safeguard its legitimate interests and/or comply with legal obligations and until any claims of participants against the Company become statute-barred.
6. Personal data will not be transferred outside the EU for processing in accordance with the purposes hereof.
7. In all events, you can contact the Company and receive any information about your personal data or exercise your rights to access, correct, delete your data, to restrict, object to or revoke processing, and to data portability. You can contact the Hellenic Data Protection Authority and submit a complaint to it about any issue of unlawful processing of your personal data.
